Hebrews 8:9 not like the covenant that I made with their fathers on the day when I took them by the hand to bring them out of the land of Egypt. For they did not continue in my covenant, and so I showed no concern for them, declares the Lord.
The new covenant is not like the old covenant made at Mt. Sinai. It is a completely new and that is why Paul can say in Romans that believers are not under law but under grace. Israel was a chosen physical nation with many privileges and blessings, but it was not a spiritually redeemed nation as Paul points out in Romans 9:8. Since they did not continue in the old covenant, God showed no concern for them. [for more see first comment]

I think the key point to remember about the old [Mosaic] covenant is that it was made with a single physical nation [Israel] and not a spiritually redeemed nation. Paul in Galatians 3:7-9 points out that the gospel was preached to Abraham and it was those of faith that are blessed along with Abraham the father of faith. The promise went on to state that all nations would be blessed as the promise was with spiritual Israel and not physical Israel [Romans 9:6].
It was the remnant of Israel that was spiritually redeemed as Paul points out in Romans 9:27. Therefore, the old covenant was made with a single nation of which most were not saved; whereas, the new covenant was made with spiritually redeemed people from every nation of the world.
Since the receipients of the covenants are different, the new covenant is hardly the same covenant under a new administration!
